We want you to be familiar with how we collect, use, and disclose information. This Applicant and Candidate Privacy Notice (“Candidate Notice”) describes how Generac collects, uses, shares, or otherwise processes personal data of applicants and candidates in connection with our application, hiring, and recruitment process, including referrals and applicants who apply directly through our online recruitment system and careers website, third-party agencies and recruiters on behalf of candidates and prospective candidates and leads who have expressed interest in receiving career-related updates and job opportunities. If you are an agency or recruiter acting on behalf of a candidate or otherwise providing personal data of a third party, please ensure that you have the right to provide such data to us and provide a copy of this Candidate Notice to any third party whose personal data you provide to us.

When we use the term “personal data” in this Candidate Notice, we are using that term to generally mean any information, or combination of information, that can be reasonably used to identify you or can be linked to you. The definition of personal data varies based on applicable law.

 

  1. WHO WE ARE

The Generac entity that is responsible for the processing of your personal data as described in this Candidate Notice and that acts as the controller of such personal data is the Generac entity that is indicated as “Company” in a job posting. That “Company” determines “why” and “how” your personal data is collected and used. A list of the Generac entities that may act as the controller can be found here.

A reference to “Generac”, “we”, “our” or “us” is a reference to the relevant Generac “Company” that is the controller of your personal data.

  1. PERSONAL DATA WE COLLECT

The types of personal data we collect depends upon the nature of the job to which you have applied or are being recruited for and the location of the job. To make it easier to understand the personal data we collect, we have organized this information into categories in the table below (however, not all categories may be applicable to you):

  • Publicly available information from publicly available sources relevant to the hiring process, e.g. your LinkedIn profile; and
  • Other information provided by you in the application, hiring, and recruitment process.

You may volunteer your previous salary and/or financial and benefit package as part of the recruitment process but we will not ask for this information.

Account Data

Personal data such as your username and password for our online recruitment system and/or talent community system.

Interview Data

Personal data collected from interviews.

Travel Data

Personal data we process if Generac is arranging travel for on-site interviews or reimbursing you for applicable travel-related expenses.

Background Check Data*

As permitted by applicable law, information received from internal and external reference and background checks, including criminal records at offer stage only (if applicable for the position you have applied for).

The results of a background check may include personal data we do not already have about you.

Citizenship and Immigration Data*

As permitted by applicable law, information related to your immigration status, visa requirements, and other right-to-work information (e.g., country of birth, passports, and residency permits).

Voluntary Diversity and Demographic Data*

On a voluntary basis and as permitted by applicable law in some countries, we may ask you to provide us with demographic information such as race, ethnicity, and veteran status. This information is used for equal opportunity monitoring. Furthermore, on a voluntary basis and as permitted by applicable law, we may also ask you to provide us with other demographic information such as age, national origin, citizenship, sex, gender identity, gender expression, sexual orientation, disability, or accommodation request. 

When you choose to provide any such information, it will not be used in the hiring decision, unless specifically permitted by law. This information will be used to help us to evaluate and improve our diversity and inclusion efforts.

Security Data 

Data such as your image and video footage captured by closed circuit television (CCTV) when you visit our locations for an interview as permitted by applicable law in some countries.

Other Personal Data

Data that you choose to voluntarily provide in connection with your application and interview or any other communications with us or, to the extent permitted by applicable law, data that you make publicly available such as contact information, your education and work experience information (e.g., when you share information via social media or job search and career networking sites), to the extent permitted by applicable law.

*There may be instances in which the personal data that you provide to us, or we collect is considered “special” or “sensitive” personal information under the data protection laws of some jurisdictions.

  1. HOW WE COLLECT YOUR PERSONAL DATA

We collect most of the personal data directly from you, for example, from your application that you submit to us. However, we may also collect personal data about you in the course of the application, recruitment and hiring process or from third parties such as references, recruiters, social media sites (e.g., LinkedIn) and publicly-available resources (e.g., job search and career networking websites).

We may also collect your personal data through service providers and other third parties that collect it on our behalf, such as communications providers, scheduling providers, and application providers, or from background and credit reference agencies (where permitted or required by law). Additionally, when you visit Generac’s careers site, we may use cookies, web beacons, tags, and scripts to measure traffic data and enable you to sign-in. If you do not provide us with your personal data, we may not be able to process your job application, or assess your suitability for a particular role, comply with our legal obligations or manage our business. We will tell you when we ask for information which is a statutory or contractual requirement or needed to comply with our legal obligations.

  1. HOW WE SHARE YOUR PERSONAL DATA

We consider the protection of your personal data to be a vital part of our relationship with you; therefore, we take reasonable measures to allow your personal data to be accessed by those who require access to perform their tasks and duties and to share your personal data with certain third parties who have a legitimate purpose for accessing it. Your personal data may be shared in the following circumstances:

  • Your personal data will be shared with Generac employees where it is necessary for them to undertake their duties with respect to our application, recruitment and hiring process.
  • We may share your personal data with Generac group companies to administer our relationship with you and for purposes consistent with this Candidate Notice.
  • We may share your personal data with our third-party dealers (entities that own and/or operate a Generac location under a license or similar agreement with Generac) if the job posting is for a position with a dealer. Generac acts as an independent controller in relation to our dealers and we are not responsible for the privacy or data security practices of our dealers, which may differ from those explained in this Candidate Notice.
  • We may also share your personal data for the purposes described above with:
  • referencesas part of the recruitment process (provided we obtained your consent, where required);
  • third-party service providersthat assist us in administering our application, recruitment and hiring process;
  • credit and criminal background check companies(where this is our legal obligation or necessary for our legitimate interest);
  • professional advisors who perform functions on our behalf, such as lawyers, bankers, auditors; and
  • government, regulatory authorities, and other organizations(such as the police or other law enforcement agents) as required or authorized by law or other regulatory requirements in jurisdictions in which we operate.
  • We may also share your personal data with third parties involved in a business transaction where we engage in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of our assets or stock, financing, public offering of securities, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities.
  • We may share your personal data: (i) at your direction or with your consent or (ii) in the good faith belief that such action is necessary to: (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of our employees, agents, members, customers and other third parties, (c) prevent or investigate possible wrongdoing in connection with our business operations, (d) enforce our Terms and Conditions, policies and agreements, (e) act in urgent circumstances to protect the personal safety of you, other individuals or the public or (f) protect against legal liability.
  1. INTERNATIONAL TRANSFERS OF PERSONAL DATA

Because of the global nature of our business, we share personal data internationally with Generac group companies or service providers when carrying out the activities described in this Candidate Policy, including the United States where we are headquartered. These jurisdictions may have data protection laws that differ from the laws where you reside, and in some cases, may not be as comprehensive or protective. Although the data protection laws of certain jurisdictions may differ from those where you reside, we take appropriate steps, such as implementing standard contractual clauses, relying on adequacy decisions and other international transfer agreements or frameworks approved by regulators and governments, to ensure your personal data is handled as described in this Candidate Notice and in accordance with applicable data protection law.

  1. RETENTION OF PERSONAL DATA

If your application is successful and you become an employee of Generac, where permitted by local law, the personal data we collect during the application, hiring, and recruitment process may be transferred to your personnel file and stored in accordance with our internal policies, which you will receive access to at the start of your employment.

If your application is unsuccessful (or you withdraw from the process or decline our offer), we will retain your information for a period after your application. We retain this information for various reasons, including in case we face a legal challenge in respect of a recruitment decision, to consider you for other current or future jobs at Generac and to help us better understand, analyze, and improve our application, hiring and recruitment process.

Where you have given us your consent to process certain Voluntary Diversity and Demographic Data (including Equal Opportunities information), we may de-identify and aggregate this information, and store it in a form that does not personally identify you, for the purpose of monitoring and improving our application, hiring and recruitment process.

If you do not want us to retain your information for consideration for other roles, or want us to update it, please contact us using the details provided in Section 13 (Contacting Us) below. Please note, however, that we may retain some information if required by law or as necessary to protect ourselves from legal claims.

  1. SECURITY RELATING TO PERSONAL DATA

We use appropriate technical and organizational measures aimed to protect your personal data against accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access. Such measures take into account the nature of the personal data and the processing and the threats posed. Where we share your personal data with third parties, we instruct them in writing to hold your data securely and in line with the requirements of applicable data protection law. Third parties must implement appropriate technical and organizational measures to ensure the security of your data.

While we endeavor to implement generally accepted security measures, no method of storage or transmission is 100% secure. In the event of a security incident, we will notify regulators and/or you as required by applicable laws and regulations. Such notice may come in the form of an email, postal mail, in-app notification or an electronic notice posted online or through our products and services.

  1. AUTOMATED DECISION-MAKING

Currently, we do not make any decisions based solely on automated processing, including profiling, which produces legal effects (“Automated Decision-Making”). In the event our position changes, we will update this Candidate Notice and inform you as required by applicable data protection laws.

11.1 Your Rights

Depending on where you live, you may be able to exercise certain rights in relation to your personal data. These rights may include the right to:

  • Obtain confirmation as to whether or not your personal data is being processed by us, and where that is the case, access to such personal data (and related details);
  • Obtain rectification of inaccurate personal data and to have incomplete personal data completed, or, to the extent required by applicable law, to have personal information annotated if we do not make the rectification;
  • Obtain erasure or deletion of your personal data;
  • Obtain restriction of our processing of your personal data or object to processing of your personal data;
  • Receive your personal data in a structured, commonly used and machine-readable format and to transmit such data to another controller where feasible;
  • Know about the existence of Automated Decision-Making and to not be subject to Automated Decision-Making;
  • Withdraw your consent at any time, to the extent we rely on your consent as the legal basis for processing your personal data (without affecting the lawfulness of the processing based on such consent prior to your withdrawal or processing based on reliance on a legal basis other than consent);
  • Lodge a complaint with the relevant authority; and
  • Obtain additional information about the suitable safeguards and means we rely upon with regard to international transfer of personal data as described in Section 7 (International Transfers of Personal Data) above.

You will not be discriminated against for exercising any of your rights described in this Candidate Notice. Please note that these rights may be subject to further conditions, limitations and/or exemptions under applicable data protection laws. If any of the rights listed above are not provided under law for your jurisdiction, we have absolute discretion in providing you with these rights.

To protect your privacy and maintain security, we may ask you to provide certain information to verify your identity and residence before granting you access to your personal data or complying with your request. We will contact you if we need additional information in order to process your request. If we are unable to verify your identity or rights to the data, we may not be able to provide you with data rights until you are able to provide us with proper documents. Where permitted by law, we reserve the right to charge an appropriate fee to cover administrative costs incurred in responding to your request, for instance, if your request is manifestly unfounded or excessive.

Under certain data protection laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.

If we process your personal data to send you these communications, you can manage your preferences in several ways. You can use the unsubscribe link in each email you receive from us to opt-out or you can manage your notification preferences within the talent community platform, which can be accessed via the portal on the top right in the header on the careers website. Please be sure to save any changes you make. Please note that opting out of these communications does not opt you out of receiving transactional communications from us such as communications about your application status.

In circumstances where we make updates or modifications to this Candidate Notice that materially alter your privacy rights, if we have retained your contact information we will provide additional notice, such as via email or with in-service notifications, as required by law. 14.2.1 CALIFORNIA RESIDENTS ONLY

Categories of Personal Information We May Collect or Disclose.  The table below sets out generally the categories of personal information (as defined by the CCPA) about California residents that we may collect and disclose to others for a business or commercial purpose (and have collected in the last 12 months).  Our collection and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such residents.

Sources of Personal Information.  In general, we may collect the categories of personal information identified in the table above from the following categories of sources:

  • Directly from individuals;
  • Referrals and references;
  • Job agencies and recruiters;

  • Vendors and service providers, representatives, and agents;
  • Social media platforms; and
  • Internet service providers and operating systems & platforms.

Purposes of Collection, Use, and Disclosure. We use the categories of personal information listed above for the purposes set forth in Section 5 Purposes For Which We Process Your Personal Data and the Legal Basis on Which We Rely above. For ease of reference, we repeat those purposes below:

  • To create, operate and manage our recruitment and talent community systems;
  • To communicate with you as part of the application, hiring and recruitment process;
  • To process and assess your application, including evaluating your qualifications, skills, interests and suitability for the job applied for and/or other opportunities at Generac;
  • To verify your information, including through vetting such as reference checks and, where applicable, background checks;
  • To book travel for on-site interviews or reimburse for travel-related expenses, where applicable;
  • To calculate proposed salary and to assess eligibility for certain benefits;
  • To consider you for, and inform you about future job opportunities;
  • To prepare your employment agreement if you are offered a job at Generac;
  • To inform the referrer of the status and final outcome of your application (if you were referred)
  • To assist you with obtaining an immigration visa or work permit (if requested by you);
  • To determine your eligibility to work;
  • To suggest suitable opportunities for you at Generac (where we have identified you as a potential candidate from information that we've collected from public sources)
  • To comply with applicable laws, regulations, legal processes or enforceable government requests (e.g., immigration and visa laws and requirements and federal and state laws related to reasonable accommodations);
  • To fulfill our obligations to relevant government authorities;
  • To evaluate and improve our diversity and inclusion strategy;
  • To monitor and improve our application process and our recruitment and talent community systems, including to run analytics on and analyze our candidate base, hiring practices or tends or to identify qualification or skills shortages;
  • To monitor our locations using CCTV;
  • To respond to your enquiries and requests;
  • To create and submit reports as required by applicable law or regulation (e.g., complying with reporting requirements of the federal Equal Employment Opportunity Commission or Office of Contracting Compliance Programs or similar state agencies); and
  • To establish, defend or exercise legal claims in an employment tribunal or any other court of law.

Retention.  We retain the personal information we collect only as reasonably necessary for the purposes described above or otherwise disclosed to you at the time of collection. For more information, please see Section 8 Retention of Personal Data above.

Sensitive Personal Information.  We only use and disclose sensitive personal information described in Categories of Personal Information We May Collect or Disclose above as reasonably necessary (i) to perform our services requested by you, (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents, (iii) to detect, prevent, and respond to malicious, fraudulent, deceptive, or illegal conduct, (iv) to verify or maintain the quality and safety of our services, (v) for compliance with our legal obligations, (vi) to our service providers who perform services on our behalf, and (vii) for purposes that are not for inferring characteristics about you.  We do not use or disclose your sensitive personal information other than as authorized by the CCPA (pursuant to Cal. Civil Code § 1798.121 and § 7027(m) of the CCPA regulations).

California Resident Rights. California law grants California residents with specific rights regarding personal information. Subject to certain conditions and exceptions, California residents have the following rights with respect to their personal information:

  • Right to Know. You have the right to request: (i) the categories or personal information we collected about you; (ii) the categories of sources from which the personal information is collected; (iii) our business or commercial purposes for collecting, selling, or sharing personal information; (iv) the categories of third parties to whom we have disclosed personal information; and (v) a copy of the specific pieces of personal information we have collected about you.
  • Right to Delete. You have the right to request that we delete personal information we have collected from you.
  • Right to Correct. You have the right to request that we correct inaccuracies in your personal information.
  • Right to Opt Out of Sales and Sharing. You have the right to opt-out of “sales” and “sharing” of your personal information, as those terms are defined under the CCPA. Because we do not sell or share your personal information, this right is not available.
  • Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to limit the use and disclosure of your sensitive personal information. We do not use or disclose sensitive personal information beyond the purposes authorized by the CCPA; thus, this right is not available.
  • Right to Non-Discrimination. You have the right not to be subjected to discriminatory treatment for exercising any of the rights described in this section.
  • Submitting CCPA Requests. California residents may exercise their CCPA privacy rights as set forth below: 

When you submit a request, please provide your full name and the email you use to interact with us (e.g., the email you used to submit your application). We will take steps to verify your identity and request by matching the information provided by you with the information we have in our records.  In some cases, we may request additional information in order to verify your identity, or where necessary to process your request.  If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.

You may also designate someone as an authorized agent to submit requests and act on your behalf.  Authorized agents will be required to provide proof of their authorization in their first communication with us, and we may also require that the relevant individual directly verify their identity and the authority of the authorized agent.

Your Rights

Subject to any specific conditions provided under applicable law, you have the following rights in respect of your personal data:

Right to Access - you have the right to request access to and a copy of any of your personal data that Generac may hold, and to obtain information about the processing of that data. 

Right to Rectify - Generac will take steps in accordance with applicable legislation to keep your personal data accurate, complete and up-to-date. You are entitled to have any inadequate, incomplete or incorrect personal data corrected (that is, rectified). You also have a responsibility to ensure that changes in personal circumstances are notified to Generac so that we can ensure that your personal data is up-to-date.

Right to Erasure - you are entitled to have your personal data erased under specific circumstances, such as where you have withdrawn your consent, where you object to processing based on legitimate interests and we have no overriding legitimate grounds (see below) or where personal data is unlawfully processed.

Right to Restriction of Processing - you have the right to restrict our processing of your personal data (that is, allow only its storage) where:

- you contest the accuracy of the personal data, until we have taken sufficient steps to correct or verify its accuracy;

- the processing is unlawful but you do not want us to erase the personal data;

we no longer need your personal data for the purposes of the processing, but you require such personal data for the establishment, exercise or defense of legal claims; or

- you have objected to processing justified on legitimate interest grounds (see below), pending verification as to whether Generac has compelling legitimate grounds to continue processing.

Where your personal data is subject to restriction we will only process it with your consent or for the establishment, exercise or defense of legal claims.

Right to Withdraw Consent - in the event your personal data is processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Data Portability - where we are relying (as the legal basis for processing) upon your consent, or the fact that the processing is necessary to perform a contract to which you are party or to take steps at your request prior to entering a contract, and the personal data is processed by automated means, you have the right to receive all such personal data which you have provided to Generac in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible.

Right to Object to Processing Based on Legitimate Interest Basis - where we are relying upon our legitimate interests to process personal data, you have the right to object to that processing based on grounds related to your particular situation.  If you object, we must stop that processing unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or we need to process the personal data for the establishment, exercise or defense of legal claims.  Where we rely upon legitimate interest as a legal basis for processing, we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis.

You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your personal data infringes applicable law.

International Transfers

Transfers to Generac group entities in the United States will be made pursuant to European Commission-approved Standard Contractual Clauses or the UK equivalent. Transfers to third parties or suppliers outside the EEA or UK may be made pursuant to the European Commission-approved Standard Contractual Clauses, the UK equivalent or other legally acceptable mechanisms that ensure an adequate level of protection, such as Binding Corporate Rules or the EU-U.S. Data Privacy Framework. Where applicable, you are entitled, upon request to privacy@Generac.com, to receive a copy of the relevant contract including the appropriate safeguards (for example, Standard Contractual Clauses and any supplementary measures) that have been taken to protect your personal data in connection with such transfer.

15.1 Not Part of any Offer of Employment

This Candidate Notice does not form part of any offer of employment and we may amend it at any time to reflect any changes in the way in which we process your personal data. If you are hired by Generac, personal data collected in connection with your application may be incorporated into Generac’s human resources system and may be used to manage the new-hire process; any such data may become part of your associated file and may be used for other employment-related purposes consistent with applicable law.

15.2 De-identified Data

We may use de-identified data. De-identified data is data that does not directly identify an individual.
